1. Acceptance & the seller
These Terms govern your use of EMKAY Luxury Living ("EMKAY", "we", "us"), operated by EMKAY Luxury Living, a real-estate technology platform based in Doha, Qatar. By accessing or using the platform you agree to be bound by these Terms.
2. Eligibility & account authority
You must be at least 18 years old. Agents must hold a valid Qatar real-estate licence and complete EMKAY verification before publishing listings. If you act on behalf of an agency, owner, or developer entity, you confirm you have authority to bind that entity to these Terms. You are responsible for safeguarding your credentials and for activity under your account.
3. Listings & user content
Agents, owners and developers are solely responsible for the accuracy of their listings (price, area, ownership, availability, photography rights). EMKAY may moderate, restrict or remove listings that are misleading, illegal, duplicated, or in breach of these Terms. You grant EMKAY a non-exclusive, royalty-free licence to host, process and display your content as needed to operate the platform.
4. Payments & Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer-service inquiries and handles returns. By completing a purchase you also agree to Paddle's Buyer Terms, which govern billing, taxes, currency conversion, renewal and cancellation mechanics. Subscription plans renew automatically until cancelled. Detailed refund rules are set out in our Refund Policy.
5. Intellectual property
EMKAY, the EMKAY logos and the underlying software, design system, documentation and analytics are the exclusive property of EMKAY. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the platform strictly within the features of your active plan. You may not reverse engineer, scrape, resell, sublicense or circumvent any technical limit.
6. Prohibited use
You agree not to: (a) use the platform for any unlawful, fraudulent or deceptive activity; (b) post fake leads or impersonate any person or agency; (c) probe, scan, scrape or interfere with the security or integrity of the platform; (d) upload malware or attempt to bypass access controls; (e) solicit off-platform commission while benefiting from verified-agent placement.
7. Suspension & termination
We may suspend, restrict or terminate your account, with or without notice, for: material breach of these Terms, non-payment, suspected fraud, security or anti-money-laundering risk, repeated listing violations, or to comply with Qatar law. You may close your account at any time from Settings; this does not entitle you to a refund outside the Refund Policy.
8. Disclaimers & liability
EMKAY is a marketplace, not a party to any property transaction. The platform is provided "as is" without warranty of fitness for a particular purpose. To the maximum extent permitted by Qatar law, our aggregate liability is capped at the fees you paid to EMKAY in the 12 months preceding the event giving rise to the claim. We exclude indirect, consequential, incidental and special damages, except where liability cannot be excluded under applicable law.
9. Governing law
These Terms are governed by the laws of the State of Qatar. Disputes are subject to the exclusive jurisdiction of the competent courts of Doha, Qatar.
