1.1. Who is responsible
EMKAY Luxury Living, Doha, State of Qatar, is the controller of personal data processed through the Platform.
We process personal data in accordance with Law No. 13 of 2016 concerning Personal Data Privacy Protection and guidance issued by the competent Qatari authority.
2.2. Data we collect
Account data: name, email, phone number, password hash, account type, language and currency preference.
Verification data: Qatar ID or passport details, licence numbers, agency affiliation, selfie/liveness images and supporting KYC documents.
Usage data: pages viewed, searches, saved properties, enquiries, device and browser information, IP address, approximate location and session identifiers.
Transaction data: plan, billing status, invoices and payment references. Full card details are handled by our payment processor and are never stored by EMKAY.
Communications: messages sent through the Platform, support conversations and complaint submissions.
3.3. Why we process data (lawful bases)
To perform our contract with you: creating accounts, publishing listings, processing subscriptions and providing support.
To comply with legal obligations: identity verification, anti-money-laundering and sanctions screening, tax and record-keeping duties.
For our legitimate interests: platform security, fraud prevention, service improvement, analytics and protecting users, balanced against your rights.
With your consent: marketing communications, optional cookies and any processing of sensitive data where consent is required. Consent may be withdrawn at any time.
4.4. Sharing and disclosure
We share data with service providers acting on our instructions: hosting and database infrastructure, email delivery, payment processing, identity verification, analytics and customer support tooling.
Listing contact details you choose to publish are visible to other users. Enquiry details are shared with the professional responsible for the listing.
We disclose data to competent authorities where required by Qatari law or a valid legal order, and to advisers or acquirers in a corporate transaction under confidentiality obligations.
We do not sell personal data.
5.5. International transfers
Some providers process data outside Qatar. Where that happens, we require contractual safeguards providing a level of protection consistent with Qatari data-protection requirements before the transfer takes place.
6.6. Retention
Account and listing data are retained while your account is active and for up to 24 months after closure, unless a longer period is required.
Verification and KYC records are retained for the period required by applicable anti-money-laundering and record-keeping rules.
Financial and tax records are retained for the statutory period. Security and audit logs are retained for up to 24 months.
7.7. Your rights
You may request access to your personal data, correction of inaccurate data, erasure where no overriding obligation applies, restriction or objection to certain processing, withdrawal of consent, and a copy of data you provided in a portable format.
Requests may be sent to privacy@emkay.world. We respond within the period required by Qatari law and may ask for identity verification first.
You may lodge a complaint with the competent Qatari data-protection authority.
8.8. Security
We apply row-level access controls, encryption in transit, restricted administrative access, mandatory multi-factor authentication for privileged accounts, device and session monitoring, and immutable audit logging.
No system is perfectly secure. Where a breach is likely to cause material risk, we notify affected users and the competent authority as required.
9.9. Children
The Platform is not directed at persons under 18. We do not knowingly collect their data and will delete it when identified.
10.Governing law & jurisdiction
This policy and any dispute or claim arising out of or in connection with it are governed by the laws of the State of Qatar.
The courts of the State of Qatar have exclusive jurisdiction to settle any dispute or claim, without prejudice to any mandatory consumer rights available to you.
Where a provision is found unenforceable under Qatari law, it is severed and the remaining provisions continue in full force.
