Terms of Service

"EMKAY", "we", "us" means EMKAY Luxury Living, a real-estate technology platform operating from Doha, State of Qatar.

"Platform" means the EMKAY website, mobile experiences, APIs, dashboards and related services.

"User" means any person accessing the Platform. "Professional" means a verified Agent, Property Owner, Developer or Agency account.

"Listing" means any property advertisement published through the Platform. "Content" means any text, image, video, document or data submitted by a User.

These Terms form a binding agreement between you and EMKAY and apply each time you access the Platform, whether or not you hold an account.

Additional policies referenced here — including the Privacy Policy, Listing Standards, Acceptable Use Policy, Payment Policy and Refund Policy — are incorporated into these Terms by reference.

Where a specific policy conflicts with these Terms on a matter it expressly governs, that specific policy prevails for that matter only.

You must be at least 18 years old and legally capable of entering into a binding contract under Qatari law.

Professional accounts must be held by a natural person authorised to bind the licensed entity they represent, and must supply valid identification and, where applicable, a valid Qatari real-estate licence.

We may refuse, suspend or terminate an account where eligibility cannot be verified, where sanctions or anti-money-laundering screening requires it, or where the account is used unlawfully.

You are responsible for the accuracy of your account information and for all activity carried out under your credentials.

You must keep credentials confidential, enable the security controls we require (including multi-factor authentication for privileged accounts) and notify us immediately of suspected unauthorised access.

We may require re-authentication, device verification or step-up verification before sensitive actions.

EMKAY is a technology platform that publishes property advertisements and connects users with licensed real-estate professionals. EMKAY is not a real-estate broker, agent, valuer, escrow agent, mortgage adviser or law firm, and does not hold a real-estate brokerage licence issued under Qatari law.

EMKAY does not act for any buyer, seller, landlord or tenant, does not negotiate on their behalf, does not receive commission on property transactions, and does not hold client money or deposits relating to a property transaction.

Any brokerage, agency, valuation, legal or financial service is provided solely by the third-party professional you engage. Their licence, conduct and liability are their own. You should independently verify a professional's licence with the competent Qatari authority before transacting.

You agree to use the Platform lawfully, to publish only accurate information, to respect the rights of other users, and not to circumvent verification, security or payment controls.

You must not scrape, harvest, resell or systematically extract Platform data without our written consent.

You must not use the Platform to launder funds, evade sanctions, discriminate unlawfully, or facilitate fraud.

You retain ownership of Content you submit. You grant EMKAY a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt for formatting, translate and display that Content for the purpose of operating and promoting the Platform.

You warrant that you hold all rights necessary to grant this licence and that your Content does not infringe third-party rights.

We may remove, downrank or suspend Content that breaches these Terms or applicable law.

Professional plans are offered on subscription. Applicable fees, billing cycles, listing allowances and any free-trial period are displayed before you confirm your order.

Paddle.com Market Ltd acts as Merchant of Record for online orders and is the seller of record for those transactions.

Subscriptions renew automatically until cancelled. Cancellation takes effect at the end of the current billing period unless the Refund Policy provides otherwise.

You may close your account at any time. We may suspend or terminate access where you breach these Terms, where required by law or a competent authority, or where continued access presents a security, fraud or safety risk.

On termination, published Listings are withdrawn and access to paid features ends. Records we must retain for legal, tax, audit or dispute purposes are kept for the retention periods set out in the Privacy Policy.

The Platform is provided on an "as available" basis. We do not warrant that listing information supplied by third parties is accurate, complete or current.

To the maximum extent permitted by Qatari law, EMKAY is not liable for indirect or consequential loss, loss of profit, loss of opportunity, or losses arising from a transaction between users.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence.

We publish a new version of these Terms with a version number and effective date. Material changes are notified in advance and, where they affect your rights, may require renewed acceptance before you continue using the Platform.

Superseded versions remain available in the Legal Centre version history.

This policy and any dispute or claim arising out of or in connection with it are governed by the laws of the State of Qatar.

The courts of the State of Qatar have exclusive jurisdiction to settle any dispute or claim, without prejudice to any mandatory consumer rights available to you.

Where a provision is found unenforceable under Qatari law, it is severed and the remaining provisions continue in full force.
