1.1. Professional status
Professional accounts are granted only after identity verification and, where the activity requires it, verification of a valid Qatari real-estate licence and agency affiliation.
You must notify EMKAY within 7 days if your licence, agency affiliation or authority to advertise changes, lapses or is revoked.
2.2. Verification and KYC
You consent to identity verification including Qatar ID or passport checks, facial/liveness comparison against the submitted identity document, duplicate-identity detection, and sanctions and adverse-media screening.
Providing false, altered or borrowed documents results in immediate termination and may be reported to the competent authority.
Approved professionals are issued a unique EMKAY Agent ID which must not be shared or transferred.
3.3. Agency responsibility
An agency is responsible for the conduct of agents affiliated to it on the Platform, including listing accuracy and enquiry handling.
Agencies must remove agents who have left the firm and must keep licence records current.
4.4. Service levels expected
Respond to enquiries within two business days, keep listing availability current, and honour advertised prices and fees.
Persistent non-response, stale listings or fee misrepresentation may lead to loss of priority placement or suspension.
5.Non-brokerage disclaimer
EMKAY is a technology platform that publishes property advertisements and connects users with licensed real-estate professionals. EMKAY is not a real-estate broker, agent, valuer, escrow agent, mortgage adviser or law firm, and does not hold a real-estate brokerage licence issued under Qatari law.
EMKAY does not act for any buyer, seller, landlord or tenant, does not negotiate on their behalf, does not receive commission on property transactions, and does not hold client money or deposits relating to a property transaction.
Any brokerage, agency, valuation, legal or financial service is provided solely by the third-party professional you engage. Their licence, conduct and liability are their own. You should independently verify a professional's licence with the competent Qatari authority before transacting.
6.6. Independent contractor status
Nothing in these terms creates an employment, partnership, joint-venture or agency relationship between you and EMKAY. You act on your own account and remain solely responsible for your regulatory obligations, taxes and insurance.
7.Governing law & jurisdiction
This policy and any dispute or claim arising out of or in connection with it are governed by the laws of the State of Qatar.
The courts of the State of Qatar have exclusive jurisdiction to settle any dispute or claim, without prejudice to any mandatory consumer rights available to you.
Where a provision is found unenforceable under Qatari law, it is severed and the remaining provisions continue in full force.
